Shon the Rabbit

Terms of Use:

Shon retains the ownership of any artwork created in the commission process.

Shon may post and use the created artwork without any restrictions.

Client may use the artwork for any personal use.

Client may post the artwork publicly and/or to their social media if there is a link back to any of Shon's social media or if any other form of appropriate credit is provided.

Client may not claim ownership of the artwork and may not remove or in any way modify or obstruct the signature if the artwork is shared publicly.

Client may not use the commissioned artwork commercially unless the client has agreed to pay the commercial use fee.

Regarding the Commission process and the contents of the Commissioned art:

The contents of the commissioned art are established and agreed upon in the pre-payment stage of the commission process

The contents of the commissioned art must be clear and unambiguous.

Failing to provide information or reference when requested by Shon results in Shon having complete freedom to interpret the content in question in any way that seems reasonable to Shon.

Regarding NSFW content:

Not Safe For Work (NSFW) content, also commonly referred to as Adult content, is all content that depicts some or all of the following:- Nudity and/or Genitalia
- Highly Sexually Suggestive Content
- Kinks and/or Fetishes
- Sexually Explicit Acts
- Excessive/Extreme Violence
- Non-Con Explicit Acts
- Gore

In cases where the commissioned art contains content that may be considered NSFW:
- The Client must clearly state the fact that the requested commission is NSFW in the initial pre-payment stage of the commission process
- Shon is required Verify that the Client is legally an Adult by requesting some sort of legal identification

Shon will not accept any NSFW commissions that contain depictions of minors, this includes content such as loli/shota/cub as well as "adult in a child body" or anything similar that tries to circumvent this through loopholes.

Payment:

Payments are made trough a PayPal Invoice, delivered to an email provided by the client.

Payments are made in full and upfront after initial discussion has concluded. Once payment is processed and confirmed, work on the commission will begin, after which , the commission will be completed within 5 days time unless specified otherwise.

Refunds:

Refunds of the commission may be issued only in the following cases, without exceptions:
- Shon cancels the commission
- Shon exceeds the agreed time for completion of the commission (5 days or if specified upon initial agreement)

When a Refund is issued, the following apply:
- Shon will immediately discontinue all work on the commission
- Client does not retain access to any files that were exchanged during the commission

In a case where the client issues a CHARGEBACK the client will be BLACKLISTED from all further correspondence and access to media provided by Shon

Misc. Terms:

Shon provides major reworks and tweaks during the sketching/planning phase as long as the commissioner is present and available to communicate, Otherwise, the artwork may proceed without input from the commissioner.
After approvals only small tweaks to the commission are permitted.

The entirety of Terms of Service may be updated occasionally (date of latest change will be visible at the top of this page) and it is clients responsibility to read them prior to any commission.
However, should the ToS change in the middle of a commission, the commission proceeds under the version of the ToS that was active at the time of the payment.

In order to better accommodate for both parties (Shon and the client), the entire Terms of Service are subject to exceptions and changes that MUST be agreed upon by both parties in the initial pre-payment phase of the commission process.

E-mails and names provided by the client for the purpose of invoicing are stored by Shon.
This data is not accessible to anyone but Shon and will not be shared or used for any purpose other than keeping track of past clients.

Commercial Use Terms:

This section only applies to commissions that have the Commercial fee applied to them (see Discounts & Fees page).

In a cases where its necessary, the artwork may be altered by the client to better suit the desired form of publishing, (e.g. cropping to fit a badge, page or cover, text covering parts of the artwork etc.)

Commercial use product must clearly indicate the creator of the artwork (@ShonTheRabbit) in an unobstructed and discernible space such as next to the artwork itself or within a dedicated credits space.
